Terms and Conditions for SmartB Smart Odds Comparison (SOC) Subscription
Subscription
- If SmartB increase the Subscription Fee, the new rate will apply to your subscription from the next billing cycle after we notify you of the price change. You will be charged the updated fee starting from the following month.
- By subscribing to our Service, you agree to pay the applicable subscription fee (Subscription Fee) as set forth on our website or as otherwise communicated to you. The Subscription Fee is payable monthly in advance for the duration of the subscription term you select.smartb.com.au/membership
- You may choose from various subscription plans, each with different durations and features. The details of each plan, including the Subscription Fee and features, will be provided to you at the time of subscription and can be found here.
Your subscription will automatically renew at the end of each subscription term unless you cancel your subscription before the end of the current term. You authorize us to charge the applicable Subscription Fee using the payment method you provide at the time of subscription.
By using this Site, you represent that you are at least 18 years old and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms of Service. If you are under 18 years old, you may not use this Site. We reserve the right to terminate your use of the Site at any time without notice if we believe that you are under 18 years old.
You may not share your account with anyone. Better Business Register reserves the right to terminate your account at any time without notice if it determines that you have violated these terms of service or any applicable law.
Membership
- This agreement commences on the date that you first visit SmartB and then after the application to become a Member is approved and continues indefinitely, or until earlier termination in accordance with this agreement. The Member acknowledges that at the time of entering into this agreement, they are not relying on any representation made by SmartB.
- To be able to gain access to information offered on 'SmartB' Web Site, you must become a Member. To become a Member, you must complete your registration form in the manner described on our Web Site.
- To register as a Member you agree to ensure that the registration details that you enter are true and accurate at all times. You must promptly notify us of any change to your registration details as originally supplied. You are responsible for maintaining the confidentiality of both your username and password and for any access to or use of our Web Site and any services available from it using your username and password. You agree to pay for your requested services in the manner specified on our Web Site.
- We will at our discretion accept or reject your membership application. We are not obliged to give reasons for rejecting your application for membership. Such reasons for rejection of an application would be in relation to false or fraudulent information being submitted.
- We may, at our discretion, terminate your membership at any time. We are not obliged to give reasons for such termination. However such reasons for termination may be in relation to false or fraudulent information being submitted or impropriate emails or phone calls to either management or support personnel.
- ‘Turnover Based Access’ and or ‘Free Access’ are at the discretion of ‘SmartB’ and its ‘Preferred Partners’ and can be withdrawn at any time without notice to you.
No Refunds
- All Subscription Fees paid directly to SmartB through the SmartB website are non-refundable. We do not provide refunds or credits for partially used subscription periods or for any unused portion of your subscription.
- By subscribing to our Service, you acknowledge and agree that you will not receive any refunds for any reason, including but not limited to dissatisfaction with the Service, changes in personal circumstances, or discontinuation of the Service.
- For subscriptions paid through either Apple or Google Subscription services, you must contact the relevant service provider directly as Better Business Register t/a SmartB is unable to provide assistance through these services.
Cancellation
- You may cancel your subscription at any time by accessing your account settings or by contacting our customer support team at subscriptions@smartb.com.au. Your cancellation will take effect at the end of the current subscription term, and you will not be charged for any subsequent terms.
- Upon cancellation, you will lose access to the Service and any associated features, content, or benefits provided to subscribers.
Commercial Use
- The 'DynamicOdds' Web Site and its systems cannot in any way or form be used for commercial purposes. There are systems in place which will automatically block any detected commercial use. This is to ensure that our members have the fastest possible service and that our servers are not being overloaded by the commercial sector.
Changes to Terms
- We reserve the right to modify, amend, or update these Terms at any time, with or without prior notice. Any changes to these Terms will be effective immediately upon posting on our website or other notification methods we deem appropriate.
- Your continued use of the Service after any such changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically for any updates or changes.
Limitation of Liability
- To the fullest extent permitted by law, we shall not be liable to you or any third party for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your subscription to the Service, including but not limited to loss of profits, loss of data, or loss of goodwill.
- Our total liability for any claims arising out of or relating to these Terms or your subscription to the Service shall not exceed the total amount of Subscription Fees paid by you during the twelve (12) months preceding the date of the claim.
Governing Law
- These Terms shall be governed by and construed in accordance with the laws of New South Wales, without regard to its conflict of law principles.
Intellectual Property
The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof), may include data that is taken from third-party sources and may not be owned or controlled by Better Business Register. Such data is provided for informational purposes only and may not be accurate or up to date. Better Business Register takes no responsibility for the accuracy, timeliness, or reliability of any information provided by third-party sources.
Better Business Register respects the intellectual property rights of others and expects users of the Site to do the same. Better Business Register will respond to notices of alleged copyright infringement that comply with applicable law and are properly provided to us.
